Terms of service

These terms of service ("Terms") govern your access to and use of the BCRM platform ("Service"), operated by Boom Logic / The Boom Company ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of terms

By accessing or using BCRM, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of service

BCRM is an all-in-one customer relationship management platform that includes CRM, AI-powered prospecting, email marketing, pipeline automation, sales enablement, and analytics. The Service is provided on a subscription basis with tiered plans that unlock different capabilities and usage limits.

3. Accounts and organizations

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Each account belongs to an organization, which is the billing entity. Organization owners are responsible for managing team members, roles, and permissions. You must notify us immediately if you suspect unauthorized access to your account.

4. Subscription plans and billing

BCRM offers tiered subscription plans (Starter, Pro, Business, Growth, and Enterprise). Plan details, pricing, and included features are described on our pricing page. Paid plans are billed in advance on a recurring basis (monthly or annually, depending on your commitment term). All fees are non-refundable except as expressly stated in these Terms or required by law. We reserve the right to change plan pricing with 30 days notice for month-to-month subscribers.

5. Commitment terms and price locks

You may choose from month-to-month billing or longer commitment periods (1-year, 2-year, 3-year, or 5-year). Longer commitments offer discounted rates and lock in your subscription price for the duration of the commitment, subject to the annual price escalator described below.

Month-to-month plans can be canceled at any time, effective at the end of the current billing period. No cancellation fees apply to month-to-month subscriptions.

6. Early termination

If you terminate a commitment plan before the end of the commitment period, an early termination fee applies. The fee is calculated as 50% of the remaining commitment balance at your locked rate. For example, if you have 6 months remaining on a $24/month locked plan, the early termination fee would be 6 × $24 × 50% = $72. You may downgrade to a lower-tier plan at any time; the new plan takes effect at the next billing cycle and resets your commitment term.

7. BoomCredits

BoomCredits are BCRM's proprietary unit of account for variable-cost actions such as sending emails, unlocking prospect data, enriching contacts, and other metered features. Each subscription plan includes a monthly BoomCredit allowance that resets at each billing cycle. Included credits do not roll over. Top-up credits may be purchased separately and roll over month-to-month but expire 12 months after purchase. BoomCredits have no cash value and cannot be transferred, sold, or exchanged outside the BCRM platform.

8. Launch pricing

Current subscription rates are introductory launch pricing, offered as a thank-you to early adopters. These rates are explicitly temporary and will increase as we continue to add social publishing, AI content creation, and conversational marketing features. By subscribing at launch pricing, you acknowledge that future price increases are planned. Commitment-locked customers retain their locked rates subject to the 4% annual escalator.

9. MSSP client access

Managed Security Service Provider (MSSP) clients of Boom Logic receive complimentary access to the BCRM platform as a perpetual benefit of their MSSP relationship. BoomCredits for metered actions are sold separately. This benefit is tied to the active MSSP subscription and ends if the MSSP relationship is terminated.

10. Acceptable use

You agree not to: (a) use the Service for any illegal purpose or in violation of any laws; (b) send unsolicited commercial emails (spam) through the platform; (c) upload or transmit malicious code, viruses, or harmful content; (d) attempt to gain unauthorized access to other accounts, systems, or networks; (e) interfere with or disrupt the integrity or performance of the Service; (f) reverse-engineer, decompile, or disassemble any part of the Service; (g) use the Service to harvest, scrape, or collect personal data in violation of applicable privacy laws; (h) resell, sublicense, or redistribute access to the Service without written permission. We reserve the right to suspend or terminate accounts that violate these terms.

11. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You retain ownership of all data you upload to the Service (contacts, companies, deals, emails, files). We do not sell, share, or monetize your data. We process your data only to provide and improve the Service. You are responsible for ensuring that your use of contact data complies with applicable data protection laws (including CAN-SPAM, GDPR, and CCPA where applicable).

12. Intellectual property

The Service, including all software, design, content, trademarks, and documentation, is owned by Boom Logic / The Boom Company and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the term of your subscription. You may not copy, modify, distribute, or create derivative works based on the Service.

13. Limitation of liability

To the maximum extent permitted by law, BCRM and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

14. Indemnification

You agree to indemnify and hold harmless Boom Logic, The Boom Company, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including privacy or intellectual property rights; (d) any content you upload or transmit through the Service.

15. Modifications to terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with any changes, you may cancel your subscription before the new terms take effect.

16. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association, with proceedings held in Delaware. You waive any right to participate in class-action lawsuits or class-wide arbitration.
